Alex is an experienced litigator and business counselor. His practice primarily focuses on: (1) litigating a broad range of business disputes; (2) representing both employers and employees (primarily executives and professionals) in employment matters; and (3) serving as outside general counsel to a wide variety of businesses.
Alex has served as lead counsel on many complex and high-profile litigation matters and has successfully resolved such claims on behalf of prominent individuals, closely held businesses, and multinational public companies. His commercial litigation practice often involves claims of breach of contract, fraud and breach of fiduciary duty, as well as all manner of claims related to intra-company disputes and business divorces. His employment litigation practice frequently involves both active litigation and pre-litigation resolution of claims related to wrongful termination, executive compensation, enforcement of restrictive covenants and other post-employment obligations, discrimination, harassment and wage and hour claims (including the defense of putative class action lawsuits).
As outside counsel to several businesses, Alex’s work often consists of providing day-to-day advice on employment and operational matters, as well as guiding clients through critical phases of their lifecycle from formation to expansion and sale, to dissolution. Alex’s broad employment counseling practice involves the representation of both employers and employees in complex matters related to hirings and terminations, employee conduct, internal investigations and developing employment policies and procedures (including employee manuals and handbooks).
While Alex represents clients from an array of industries, he devotes a significant portion of his practice to representing clients within the hospitality and food and beverage space in connection with both disputes and general business and employment matters. His clients in this area have included Michelin-starred chefs, restaurant groups, investors, importers and a variety of well-known food and beverage brands.
In addition to his general commercial and employment practice, Alex also has particular expertise in legal and accounting malpractice and other professional liability matters and has both prosecuted and defended dozens of such claims.
Alex has been recognized by Super Lawyers Magazine several times and has lectured and published on topics ranging from esoteric procedural litigation mechanisms to the laws governing the production and sale of wine around the world.
A small sample of Alex’s litigation matters while at KBG include:
- Representing the sellers in the then-largest residential property transaction in the United States in a breach of contract action against The Corcoran Group relating to brokerage commissions purportedly due in connection with the sale. The clients won summary judgment after more than five years of litigation.
- Representation of a global software company in a breach of contract action against a celebrity-backed technology company in the influencer space. The client secured a judgment for the entire amount sought in the case, plus interest and attorneys’ fees. Thereafter, KBG secured even more than the total judgment amount through aggressive judgment enforcement efforts, which included locating and restraining funds and securing a court order for the turnover of those funds.
- Representing a Michelin-starred chef in connection with the defense of a breach of contract claim brought by a restaurant group. The client won a pre-answer motion to dismiss the claims with prejudice.
- Representing a senior technology executive in a federal litigation related to the non-payment of severance and alleged violations of post-employment obligations. The case was settled confidentially after extensive motion practice on multiple issues of first impression.
- Representing a prominent group of bar and nightclub owners in the defense of a putative wage and hour class action lawsuit in federal court.
- Representing a Czech businessman in a federal civil RICO action seeking more than $1 billion in damages in connection with an alleged conspiracy to secretly acquire a controlling share of a major Luxembourg-based commercial real estate development company. The client won pre-answer dismissal in the SDNY, which was later affirmed by the Second Circuit.
- Representing a manufacturer of beauty products in litigation against a global superstar related to a dispute over a licensing and celebrity endorsement deal.
- Representing personal injury attorneys in connection with a high-profile law firm dissolution and related litigation.
- Representing a leading surgical group in connection with a AAA arbitration related to a partnership dispute with their former partners.
Alex began his career as an associate at a major global law firm, after graduating magna cum laude from Syracuse University College of Law as Executive Editor of the Syracuse Law Review. He also spent one year serving as a law clerk extern to the Hon. Frederick J. Scullin, Jr. of the U.S. District Court, Northern District of New York and the Hon. Marian W. Payson of the U.S. District Court, Western District of New York.
Alex lives in Brooklyn Heights with his wife and two sons. He is originally from Rochester, NY and is a rabid fan of the Buffalo Bills. He is a member of the Wine & Food Society of New York and the New York American Inn of Courts, where he’s been an active participant in the Wine & The Law program.
