KB&G’s attorneys have extensive experience counseling and representing marketers, advertisers, agencies and suppliers, among others, in a wide array of matters, including investigations and litigation commenced by state attorneys general, state regulatory agencies, public utilities commissions and the Federal Trade Commission (FTC). They also represent clients in business-to-business disputes.

The firm frequently represents clients in class action defense in federal and state courts, including actions brought pursuant to the Telephone Consumer Protection Act (TCPA).  KB&G’s attorneys regularly counsel clients regarding the laws applicable to their businesses, including the TCPA, CAN-SPAM Act, the FTC Act and state marketing laws.

KB&G’s attorneys review advertising and promotional campaigns before launch to help ensure compliance with applicable laws. They regularly draft and negotiate all types of business contracts and Internet-related agreements, including marketing agreements, non-disclosure and confidentiality agreements, licensing agreements, as well as website terms and conditions, privacy policies, social media policies, technology services agreements, and sweepstakes and contest rules.  KB&G’s attorneys routinely counsel and train clients on data privacy and security.

KB&G also assists clients in the removal of defamatory, infringing and negative material from the Internet.  Its attorneys frequently lecture on this topic and the importance of protecting clients’ reputations on the Internet.

The firm also works with clients to protect their telecommunication and Internet-related trademark and copyright rights.  KB&G has represented on-line advertising service providers, MMO and RPG developers, and numerous on-line companies in litigation, including under the Lanham Act and state unfair competition laws.
